Terms and Conditions of Service for Ross Tech 360 HVAC
1. Introduction These Terms and Conditions ("Terms") govern the use of HVAC services provided by Ross Tech 360 HVAC ("Company", "we", "our", or "us") to its clients ("Client" or "you"). By engaging with our services, you agree to comply with these Terms. Please read them carefully before using any of our services.
2. Scope of Services Ross Tech 360 HVAC provides installation, repair, maintenance, and consulting services related to heating, ventilation, and air conditioning (HVAC) systems. Specific services will be detailed in individual service agreements between the Company and the Client.
2.1 Service Availability Service availability depends on your location, the nature of the service, and technician availability. Emergency services may incur additional fees.
2.2 Service Appointments Appointments must be scheduled at least 48 hours in advance. The Client must ensure accessibility to the HVAC system or equipment prior to the scheduled service time. Failure to do so may result in additional charges for time lost.
3. Quotes and Estimates Any quotes or estimates provided by the Company are non-binding unless agreed upon in writing. The cost estimate may be subject to change based on the actual scope of work. In case of cost variations, we will seek your approval before proceeding.
3.1 Pricing Pricing for services may be hourly, flat rate, or project-based, depending on the specific service provided. Any special offers or promotions are subject to specific terms and may not be combined with other offers unless explicitly stated.
3.2 Payment Terms Full payment is due upon the completion of services unless otherwise specified in a written agreement. The Client may pay via cash, credit card, or bank transfer. Delayed payments may incur a late fee of $30 per day, and services may be suspended until payment is received.
4. Warranties We offer limited warranties on certain services and equipment, as outlined below:
4.1 Service Warranty We provide a 60-day warranty for workmanship on repairs and installations. If a fault arises during this period due to our work, we will rectify it free of charge.
4.2 Equipment Warranty Any equipment installed by Ross Tech 360 HVAC is subject to the manufacturer's warranty. We will assist in processing warranty claims but are not liable for the terms set by manufacturers.
4.3 Exclusions Warranties do not cover damages caused by improper use, neglect, third-party interference, acts of God, or other external factors outside of the Company's control.
5. Client Responsibilities The Client agrees to maintain the equipment as per the manufacturer’s recommendations and comply with service schedules provided by Ross Tech 360 HVAC.
5.1 Access You must ensure that we have access to your property and the HVAC system at the scheduled service time. If we cannot access the system due to obstructions, a missed service fee may apply.
5.2 Environmental and Safety Standards The Client agrees to ensure that the HVAC system complies with local environmental regulations and safety standards. Any required upgrades or modifications will be quoted separately.
6. Liability Ross Tech 360 HVAC is not responsible for:
Any indirect, incidental, or consequential damages arising from the services provided, including but not limited to loss of business or property damage, unless caused by gross negligence or willful misconduct.
Delays caused by external factors such as weather, supply chain disruptions, or other unforeseeable events.
6.1 Limitations of Liability Our maximum liability for any claim related to the services will not exceed the total amount paid by the Client for the specific service.
7. Termination and Cancellation Both the Client and Ross Tech 360 HVAC reserve the right to terminate services under certain conditions:
7.1 Client-Initiated Termination The Client may cancel a service within 24-48 hours without penalty. Cancellations made after this period may incur a cancellation fee of $120.
7.2 Company-Initiated Termination Ross Tech 360 HVAC reserves the right to terminate services if:
The Client fails to meet payment obligations.
The Client violates any of the terms and conditions.
Environmental or safety conditions at the Client’s location present hazards to our technicians.
8. Intellectual Property All content, documents, and resources provided by Ross Tech 360 HVAC during the service process remain the intellectual property of the Company and may not be reproduced or distributed without prior written consent.
9. Data Privacy Ross Tech 360 HVAC respects your privacy. Any personal data collected from you will be used solely for the purpose of providing services and maintaining communication. We will not share your information with third parties except as required by law or with your explicit consent.
9.1 Use of Personal Data We collect and store information such as your name, contact details, and payment information to fulfill service requests. This information will be kept confidential and used only for necessary business functions.
10. Force Majeure Ross Tech 360 HVAC will not be held liable for delays or inability to perform services due to events outside of our control, such as natural disasters, pandemics, labor strikes, or government restrictions.
11. Governing Law and Dispute Resolution These Terms and Conditions shall be governed by and construed in accordance with the laws of States we do business. Any disputes arising from these Terms shall be resolved through mediation. If mediation fails, disputes shall be settled in the competent courts of jurisdiction.
